Unless you actually have some kind of legal copyright, there's nothing really you CAN do. Generally, website designs can not be copyrighted, only the unique logo for the company. There are many "templates" available that can make one person's web site look very much like another's, and that is NOT any kind of infringement.

Talk to a lawyer. They can advise you and send a cease and desist letter.

do you have a copy right on it. if not then take it that your site was so good that someone copied it

Content is copyrightable, not design.

1. Find out how to register your intellectual property with the U.S. copyright office. http://www.copyright.gov will give you all the details.
2. After you have your web site registered, you can sue anybody who rips off your design.
